At Bassey Immigration Law Center, P.A., We Know What You’re Going Through

If you are researching an EB visa, you want a real future in the United States. The US government offers several employment-based visa categories, known as EB-1 through EB-5. These visas allow you to earn a green card based on your professional achievements, your education, your job skills, your qualifying status as a special immigrant, such as a religious worker, or your business investments.

Choosing the right category is the most important decision you will make. Every EB visa has a unique set of requirements and demands specific legal proof.

At Bassey Immigration Law Center, we have more than a decade of legal experience resolving a wide range of challenging immigration issues. Our multilingual team fully understands the immigrant experience and knows how to successfully fight for your future. Schedule a consultation today.

Evaluating Your Pathways: Which EB Category Fits Your Career?

The government groups employment-based green cards into five categories, EB-1 through EB-5. Each has its own eligibility requirements.

EB-1: Priority Workers and Global Trajectories

This tier is for people who have reached the top of their field: international professors, outstanding researchers, multinational executives, and individuals with exceptional achievement in business, science, the arts, or education.

If you qualify as an individual of extraordinary ability, you can file for yourself, without an employer sponsoring you. Examples include a scientist with major awards or a body of highly cited work, an executive with a sustained record of achievement, an artist recognized through critical acclaim, or an athlete recognized at a national or international level.

Professors and outstanding researchers, along with multinational executives, still need an employer to sponsor the petition.

EB-2: Advanced Degree Professionals and Innovators

If you have a master’s degree, a Ph.D., or a bachelor’s degree plus five years of progressive work experience, this is often your best option. Normally, a US employer has to sponsor you through a complex labor certification process with the Department of Labor, proving there are no qualified US workers who are available for your position.

However, we can often bypass that step by requesting a National Interest Waiver (NIW). If we can show that your work brings clear value to the country, the government will allow you to sponsor yourself.

EB-3: Skilled Workers, Professionals, and Essential Staff

This visa keeps American businesses running by bringing in essential talent. It covers professionals with a bachelor’s degree, skilled workers with at least two years of experience, and other essential staff. For this track, you must have a permanent, full-time job offer. We work directly with your employer to satisfy the government’s rules and secure your spot.

EB-4: Special Immigrants

This is a small, highly specific category for a narrow set of professional groups. Examples include religious workers such as ministers and members of religious orders, employees and retirees of international organizations like the UN, special immigrant juveniles under state court protection, and certain broadcasters employed by US government agencies such as Voice of America.

EB-5: Immigrant Investors and Entrepreneurs

For business owners and investors looking to anchor their operations in Florida’s economy, the EB-5 program offers a direct, self-funded path to residency. You gain a conditional green card by investing capital into a new US enterprise.

As long as your business enterprise creates ten full-time jobs for US workers, you, your spouse, and your children under 21 can receive a conditional green card. After two years, you’ll need to show that the investment and job creation requirements were met to remove the conditions and gain permanent residency.

Avoiding Critical Mistakes That Delay Your Case

The immigration system leaves little room for error. The government routinely uses minor errors or missing details as an excuse to pause your application or deny it completely. A single mistake can stall your career and put your family’s plans on hold.

Our legal team acts as your frontline defense against these structural traps. Depending on your category, we ensure your employer pays the exact mandatory wage, build exhaustive evidentiary portfolios to prove your professional accolades, or verify that your everyday job duties match your university degree with precision. Whatever your case requires, we actively audit every piece of evidence before it reaches a federal reviewer.

An experienced Business and Employment Immigration Lawyer helps strengthen your application’s chances of passing federal scrutiny on the first attempt.

Can an EB Visa Lead to US Citizenship?

A foundational question for almost every immigrant worker is: Can an EB visa lead to US citizenship? The answer is yes. An employment-based visa is an investment that yields permanent returns. Because EB-1 through EB-5 are immigrant visas, your approved petition results in a green card and grants you status as a lawful permanent resident.

Holding a green card is the mandatory first step to becoming a citizen. Once you live here as a permanent resident for five consecutive years and meet the standard rules for living here and showing good character, you can apply to fully naturalize.

The professional journey you begin with our firm today can secure your permanent future as an American citizen.
